Moved over to Turkey in 2011

Letter from UK

After some California weather we are now back to constant hot and humid ?stanbul days. First email; “Dear Berk Çektir, I live in the United Kingdom. I would very much appreciate it if you could answer a simple query I have regarding co-ownership of a property. I own 50 percent of a property and someone else also owns 50 percent of the property. We agreed upon purchase that it was not to be rented out. We have furniture and fittings in the apartment that are very expensive and the rental income would not cover any damages. Can they rent out the apartment without my consent or do they expressly need my permission to do this? Any help is welcome. Many regards, Mr Bracken”

Dear Mr. Bracken, I presume that you wrote this letter from the UK, where you have a keyboard without any Turkish letters. I appreciate that you bothered yourself finding the letter “Ç” instead of simply using the letter “C.” They need to have your express consent to rent the apartment out. Of course real life is always faster, and what happens if they rent it out without your consent? You can simply go to court for an eviction. If you have this agreement on not renting the apartment in writing, it would be much easier to get the tenant out of the house.

Second email; “Hi, Please can you help me, I need to know how to get a holiday visa or any visa for just two weeks for my engagement. Anyway how to go to UK and return for him he is Turkish and 42 years old. How do we do this he also has family there if this helps. They own a restaurant. How can we go to UK together? How much is the cost and what paper work do we need? Also maybe a visa for marriage to be and organize. Lorraine.”

Dear Lorraine, your email is unclear. I guess that your fiancé is willing to come and live in the UK with you. This is a matter for which you should seek advice under English law. You can get more info on the website of the British home office.

The third one: “I wonder if you could assist me in any way? I moved over to Turkey in 2011, initially on a tourist visa after being advised by many to apply for residency when I actually move to Turkey. I married my husband in 2010 and have left my life in the UK to be a housewife in Turkey. My Turkish in-laws have provided us with an apartment within the family block in ?zmir. Although this is ours, it remains in my father-in-law’s name.

To cut a long story short, we are unsure where we start with regard to obtaining a more permanent right for me to stay in Turkey. I will be living here for the foreseeable future with no plans to return to the UK and for obvious reasons (not speaking Turkish — yet, etc.) will remain a housewife with no incoming salary. I would be grateful if you could advise at least where we should start in obtaining a more permanent visa and what our options are as my husband has been to the local police station and they knew nothing about obtaining a visa for a foreigner. With best wishes and kind regards, Sasha”

Dear Sasha, you should visit the foreigners department in charge of issuing the residence permit. Since you are now married to a Turkish citizen and you are a citizen of the UK, which is a Group A country, assuming you have no criminal record or other problems, you should have no problems in getting a residence permit.

Please visit the website of the police headquarters and you will find the contact details of the police station in charge of this matter. A local police officer would have no idea about this matter. I would also suggest that you hire a lawyer to assist you in this matter which would make things much easier for you.
